1. What is a Prospectus?

Prospectus is simply giving information. The House of Peoples Representatives has set strategies of collecting information from different stakeholders in order to enable it to exert its powers of control and supervision. This document is prepared to provide information to the House about the issues that are believed to be out of the sight of the house.

Purpose:

  • To ensure there is utilizing public and government resources and property;
  • To ensure jobs are done based on law and order;
  • To ensure there is a fair and fast development direction;
  • To ensure democracy and good governance;
  • To ensure the rights of citizens, peace and tranquility
  • To ensure that there is a consistent coordination among the government bodies.

Who will make a referral to the house?

  • Governmental entities
  • Committees
  • Community
  • Non-governmental entities

2. Recommendation & Concerning bodies

Whose recommendation is available?

  • For the good offices
  • For the Speaker
  • Standing Committees
  • The member of the school is not a referendum that the House will bring to the House,

Concerning bodies of the suggestion:

  • The Federal Government
  • Issuance and Control of Violations in a Region (It is not possible to submit a report to the Public Affairs on matters falling outside jurisdiction)

3. Particular Points

Particular points of suggestions to the House:

  • Concerning injury or damage to the State or public interest and use of the property;
  • When it is assumed that the constitution is in danger or creates a threat,
  • When a government policy and strategy is obstructed;
  • When there is a conflict between the peoples or a conflict that may arise,
  • When human rights are violated and high artificial and natural disasters occur
    • Otherassisting issues that may help in monitoring, supervising, taking action, attention or awareness by the house.

4. Unconditional Issues

  • Issues that have been judged or resolved in court - Federal High Court, Supreme Court, Urban Court, Military Court and Sheria Court
  • Issues that have been resolved in full or partial judicial or administrative proceeding under the law Labor Board, Board of Appeal, Tax Appeals, Discharge Appeals and Others
  • Issues that have been identified or settled by an established body to investigate cases under law that have been seen or observed by establishing a temporary committee
  • If it is directly approached other than observed by someone else, the suggestion may be rejected

5. Other Issues That Could Lead to Rejection

  • If it does not support the facts of the case with sufficient and substantial evidence
  • If it misses the full name, full address, and signature of the informer(s)
  • If the text is dull and unreadable
  • If it does not respect the dignity of the House, and affects the rights and dignity of other people
    • If the case is before the other party, do not mention that person and the answer
    • If the referee is a corporation, there will be no signature and stamp from the head of the organization
    • If the matter is not presented into the power of the relevant Standing Committee
    • Important information but lacks human and material evidence
    • Not making a sworn oath (no justifications of witnessing and documenting)

6. Confidentiality

  • The identity of the informer shall be kept confidential by the House, the members and the Standing Committees
  • The testimony heard and the document remain confidential if it is asked to be kept confidential
  • The House confirms if proper legal protection is provided to the referring party
  • Disciplinary action will be taken against non confidential member from a simple warning up to dismissal from the house.

7. Information Refinement

The Speaker of the House or Standing Committees may check the appropriateness of the information

  • When a suggestion should be taken on the other party's side is submitted directly to the House
  • Making information available to the appropriate body
  • Receive the referral directly and send it to the appropriate body
  • Ordering to make the final decision if the information is sent directly to the appropriate body
    • On the date of the submission of the information, the Speaker or the Standing Committee will inform the client on any of the other issues that may lead to a rejection of the claim.
    • The speaker and the standing Committees may inform the rejection recommendation to the Constituent body within two working days
    • A Standing Committee that has received a prospectus out of its authority shall be able to return the matter to the concerned body

8. Examining Evidence

Examining evidence by witness and document

  • The testimony of a witness is supported by written document or
  • The question may be given in verbal responses
  • The non-requested but additional information may be provided if the witness wishes to provide further information

Document review

  • It may be the original or the copy of the document
  • The documents are returned after investigation
  • The restrictions and freedoms set forth in the Constitution and by other laws, through the hearing and the presentation, are respected

9. Reflective Response Time

  • Responses should be reflected within a month (break time is not considered)

Actions to be taken:

  1. - By the Speaker
    • Discuss with the relevant body to solve or to correct the issue
    • Assist the appropriate standing committee on the recommendation of the appropriate resolution
    • Fill the agenda with a meeting if decision is needed
  2. - By the Standing Committee
  • Discuss with the relevant body to solve or to correct the
  • Reporting and proposing a recommendation to the House for decision
  • Conducting a precautionary measure or a temporary suspension by the Speaker
  1. - By the House
  • If the problem arises from a legal gap, it will fill in the law
  • It is necessary to make the necessary adjustments due to budget shortages
  • Instructing the department to inform and correct the problem
  • If the problem is not resolved, it will take action against the alleged offender through the Prime Minister
